Congratulations upon your publishing Brosnahan's article. It is an intelligent, objective, and clearly stated demonstration of the principles that are actually involved in the Supreme Court retention issue.

The propaganda that has characterized the campaign against retention has been presented in such ways as to take advantage of the restrictions imposed upon all justices against their "expressing personal views concerning important public issues, promising to vote a particular philosophy in future cases, discussing pending cases or responding to media criticism by explaining past cases."

Because of such restrictions that are imposed by the Code of Judicial Conduct, it is all the more important that statements such as Brosnahan's be made public.
