FMC will appeal the dismissal of its Boesky suit.

Chicago-based FMC in its suit against Ivan F. Boesky, Goldman, Sachs and various other parties alleged insider trading, misuse of information and price manipulation relating to FMC's $2-billion recapitalization completed last year. Goldman, Sachs acted as investment adviser to FMC during its recapitalization. On April 16, U.S. District Judge Ann C. Williams dismissed FMC's lawsuit, ruling that Boesky's trading in FMC stock did not injure the company and did not prevent its recapitalization.
