Former Councilman Robert Fry has filed a lawsuit against Mayor Eugene Moses seeking $500,000 in damages for malicious prosecution.
The suit, filed in Pomona Superior Court, says that Fry incurred "mental and emotional distress" and had his reputation harmed by a lawsuit that Moses filed against him five years ago. In the 1982 suit, Moses accused Fry and others of circulating rumors that Moses had beaten a woman and molested her daughter. The suit ended when an arbitrator ruled that Moses had failed to state a cause of action against Fry. Moses said the case was lost because his attorney failed to appear at the arbitration hearing.
