San Gabriel Valley : TRIAL DELAYED

The city of West Covina has agreed to delay a trial on its lawsuit seeking the closure of the BKK Corp.'s mountain-sized landfill until January, in the wake of a business deal that could see the dump shut by next spring.

West Covina is continuing to pursue the lawsuit, but its attorneys this week accepted a Los Angeles Superior Court judge's recommendation to delay trial until Jan. 10, city officials said.

The lawsuit, originally slated for trial this month, alleges that BKK reneged on a 1985 agreement to close the dump by this November. BKK contends that it can operate the dump to 2006.

"We remain optimistic that BKK will close its gates in West Covina thanks to this deal," said West Covina City Manager James Starbird. "But with so many ifs that could halt the deal, we're continuing litigation."
