Man Sentenced for Attack at Gay Video Display

HOLLYWOOD — A man accused of attacking a liquor store customer looking at a display of gay videos was sentenced to 25 days in jail, the Los Angeles city attorney's office said.

Brian Fernandez was sentenced to jail and three years' probation Wednesday after he pleaded no contest to one count of using force to threaten a person because of his sexual orientation. Fernandez, who was sentenced in Los Angeles Superior Court, was also ordered to stay away from the 43-year-old victim.

A prosecutor said Fernandez walked up to the victim in a liquor store in the 5500 block of Sunset Boulevard on March 9 and asked if he was gay. When the victim said yes, Fernandez said he hated gays, threatened and assaulted him.

The incident was captured on a surveillance camera. Two LAPD officers arrested Fernandez nine days later after they recognized his photograph.
