Ariel Winter to remain in sister's care until trial, judge rules

Ariel Winter of "Modern Family" will continue to be under the guardianship of her older sister until a trial is held that will ultimately decide the 14-year-old's custodial fate, a judge has decided.

The young actress' allegations of emotional abuse by her mother, Chrisoula Workman, were determined to be substantiated, according to a Department of Children and Family Services report that was reviewed Tuesday at a hearing in Los Angeles, L.A. Now reported.

Allegations of physical abuse were inconclusive, the report said. Workman denied all allegations of abuse, getting backup from her son, Jimmy Workman, who had previously called the accusations "totally untrue."

DCFS recommended that custody go to Shanelle Gray, 34, and considered the situation serious enough that it considered taking steps to make Winter a ward of the state rather than have custody returned to Chrisoula Workman, according to TMZ.

Winter, real name Ariel Workman, has been living with Gray since early last month, when a judge ordered Chrisoula Workman to stay away from her younger daughter pending a hearing. Gray was removed from her mother's custody 20 years ago amid similar accusations.

Winter's father, Glenn Workman, on Monday had filed an objection to Gray's request for guardianship of his daughter, saying he was capable of taking care of the younger girl (the parents have been separated for a while, and he lives outside the family home, People said). The judge denied that request.

Also in the mix: Shortly after Winter took legal action to get away from her mom, Chrisoula told sheriff's deputies she'd caught Ariel's then-boyfriend, an 18-year-old, allegedly having sex with the actress. Winter and Cameron Palatas, also an actor, have since broken up, E! News reported.
