SAN DIEGO - In early returns Tuesday, San Diego Councilman Kevin Faulconer appeared headed for a runoff election with either former Assemblyman Nathan Fletcher or Councilman David Alvarez to succeed the disgraced Bob Filner as mayor. While Faulconer, 46, the only Republican among the major candidates, had a sizable lead, he appeared to lack the 50% plus one vote needed to win the job without a runoff. Fletcher, 36, was narrowly ahead of Alvarez, 33, a fellow Democrat. A third Democrat, former San Diego City Atty.

Arguing that pretrial publicity has ruined any chance that David Alvarez can receive a fair trial in the county, attorneys for the murder defendant want a judge to move the trial to another venue. The request comes before Superior Court Judge Rebecca Riley today and is one of several court briefs that must be resolved before the trial. Alvarez, 23, has pleaded not guilty to murder and attempted rape in the December 1998 slaying of Oak View teenager Kali Manley.

SAN DIEGO -- With more than half the votes counted Tuesday night, Councilman Kevin Faulconer had a sizable lead over Councilman David Alvarez in the special election to replace former Mayor Bob Filner. Faulconer, 47, a Republican, was leading Alvarez, 33, a Democrat, by 57% to 43% among the 166,599 ballots that were mailed in or brought to the elections' department before Tuesday's balloting. Assuming that the overall turnout is in the range of 40%, as many political pros expect, those 166,599 ballots would account for about 60% of the overall vote.
David Alvarez, the man who led investigators to the body of 14-year-old Ventura County resident Kali Manley, will be charged with her murder possibly as early as today, authorities said. But it is unclear if the case will be handled by local prosecutors. Dist. Atty. Michael D. Smirking and minimizing his criminal conduct to the end, David Alvarez was sentenced Thursday to 25 years to life in prison for the slaying of Kali Manley, the Oak View girl whose disappearance and death punctured the illusion of safety for residents of the Ojai Valley. Against the advice of his attorneys, the 23-year-old defendant stood in Ventura County Superior Court and read a handwritten statement in which he said he isn't even sure the 14-year-old girl died at his hands.
