Opening arguments are scheduled Mondayon a court challenge to the San Gabriel Valley's Foothill Transit Zone, which began bus service late last year. Drivers and mechanics of the Southern California Rapid Transit District sued the zone last year, claiming that the agency threatened union jobs and constituted an illegal breakup of the RTD. The trial was scheduled to begin this week in Los Angeles Superior Court, but Judge Eli Chernow continued the case because one of the attorneys involved had a personal emergency.

The L.A. transit strike has disrupted the city's immigrant-driven economy, touching the lives of nearly every resident. It has been a game played at the public's expense that neither the Metropolitan Transportation Authority nor the unions deserve to win. Both sides have systematically exploited taxpayers. The strike has induced the public and the political establishment to contemplate the unthinkable: Los Angeles without the MTA.

A month ago, officials from the fledgling Foothill Transit Zone were boasting about how the new transit agency would soon provide better, cheaper bus service for the San Gabriel Valley. Now, after two court losses have derailed the pioneering project, zone officials are wondering when--and if--the transit agency will get started.

A plan to split up the Metropolitan Transportation Authority and form a separate transit zone in the San Fernando Valley would not only be feasible, it would do better financially than the existing superagency, according to a report released Monday. The thick single-volume document, prepared by a group of independent consultants, examined operations, bus service development and staffing of a Valley system, as well as similar breakaway bus agencies.

The Southern California Rapid Transit District has been making a lot of noise lately about being held hostage by the Los Angeles County Transportation Commission. But officials haven't said one word about the RTD itself holding the bus riders in the San Gabriel Valley hostage. RTD seems to have put its turf ahead of its riders. We think that there is a way for the RTD to get out of a financial disaster that the RTD itself has created. The Foothill Transit Zone was approved by the commission almost one year ago. This zone will run 20 lines that the RTD has operated--with cost savings of more than 35% and better service than the RTD provides.

The governing board of Foothill Transit Zone on Tuesday authorized its executive director to purchase up to 60 buses if a favorable court decision is reached in a lawsuit that challenges the transit zone's existence. A monthlong trial ended last week in Los Angeles Superior Court with Judge Eli Chernow taking the case under submission. Chernow has 90 days to issue his decision. The case concerns the county Transportation Commission's approval and funding of the Foothill Transit Zone, which operates two bus routes formerly operated by Southern California Rapid Transit District in the San Gabriel Valley.

The Los Angeles County Superior Court put an end to a longtime bus war between two competing agencies in the San Gabriel Valley when it ruled Tuesday in favor of Foothill Transit Zone. The lawsuit came about because two transit agencies--the Southern California Rapid Transit District and Foothill--had been serving the San Gabriel Valley.

The president of the 5,000-member union representing the Southern California Rapid Transit District drivers said the union will appeal last week's court decision allowing the Foothill Transit Zone to compete in the San Gabriel Valley. Foothill Transit, a partnership between 20 cities and the county, contracts with private bus companies to provide service.

Despite strong appeals from San Gabriel Valley officials, the Southern California Rapid Transit District has indefinitely postponed consideration of a low-cost, privately run transit agency. The RTD board of directors has tabled a motion by Charles Storing, a La Puente councilman and the San Gabriel Valley representative on the RTD board, consenting to the formation of a Foothill Transit Zone until the RTD's lawyers can review the district's legal liability.

The California Supreme Court, responding Friday to pleas from lawyers for the Foothill Transit Zone, granted a request that will temporarily allow the bus system to continue taking over San Gabriel Valley routes of the Southern California Rapid Transit District. The court, however, ruled that Foothill could add only four more existing RTD lines, pending the outcome of legal challenges by the two unions that represent more than 7,000 RTD drivers and mechanics.

Imagine: A mass transit agency that has increased bus ridership by 120%, increased hours of service by 126%, reduced costs by 55% and generates more money from the fare box. Now imagine a graffiti-free bus, because the operating company is fined if graffiti isn't cleaned off within a specified time. On top of all that, imagine a bus fare 34% cheaper than the Metropolitan Transportation Authority's and an unlimited senior pass that's also 34% cheaper than the MTA. You can't imagine any of that?

Gov. Gray Davis kept hopes for a San Fernando Valley transit zone alive by vetoing a labor-backed bill two weeks ago, but supporters of local control of Valley buses still face a long road ahead. The bill would have forced new operators of bus services to match the worker wages and benefits provided by the Metropolitan Transportation Authority, the regional agency that plans and funds public transportation in Los Angeles County.

In a move that could herald more local control of transportation for the San Fernando Valley, an MTA committee unanimously approved guidelines that would make it easier to create a Valley transit zone, officials said Friday. County Supervisor Mike Antonovich, a Metropolitan Transportation Authority board member who backed the action, called the Planning and Programming Committee's Thursday vote a "major victory for commuters, local control and the taxpayers."

What the MTA Board of Directors, including Mayor Richard Riordan and CEO Julian Burke, do not seem to understand is that government has the duty and responsibility to provide adequate transportation for its citizenry, regardless of the cost. This is spelled out in the MTA charter. The system is supposed to grow with the population and follow the business community with at least bus lines to carry workers and even some customers. Let us start our project in the San Fernando Valley.

Foothill Transit says it is listening to its riders. In a meeting next month to determine rate and and other changes throughout the San Gabriel Valley, the executive board of Foothill Transit is expected to present a proposal culled from the public's suggestions, officials said. Changes in bus fare were scheduled for implementation in January.

The City Council voted this week to approve the joint powers agreement that will create the Foothill Transit zone, despite the opposition of Councilman C. L. (Clay) Bryant, who said the city could be held liable in any legal action against the new bus district. After City Atty. Patrick Sampson assured the council that the city would not be held liable in lawsuits against the 20-city transit district, the council voted 3 to 1 in favor of signing the agreement.

A private transportation agency formed as a cost-saving alternative for the San Gabriel Valley will have the same fare structure--for at least its first six months--as the Southern California Rapid Transit District. At its first meeting this week, the board for the Foothill Transit Zone narrowly approved the fare structure over objections that it should be lower than RTD's.
