In his first appearance before a federal magistrate in Orange County, former Tustin gynecologist Ivan C. Namihas pleaded not guilty Monday to mail fraud for allegedly billing his patients for unnecessary tests and treatments. Flanked by his wife, Rebecca, and attorneys from California and Nevada, Namihas entered the plea before U.S. Magistrate Elgin Edwards in an arraignment that lasted less than one minute. Edwards set a trial date of Oct. 11 before U.S. District Court Judge Alicemarie H. Stotler.

In one of California's worst cases of patient abuse, a former Tustin gynecologist was sentenced Monday to two years in prison by a federal judge who reprimanded him for bringing "shame to a noble profession." Dr. Ivan C. Namihas, once the subject of the largest sexual abuse medical investigation in state history, was led out of the courtroom in handcuffs after he was also ordered to pay a $40,000 fine and $12,000 in restitution.

A federal judge told jurors to continue deliberations Monday after they announced they could reach a verdict on only one of 10 mail fraud counts against former Tustin gynecologist Ivan C. Namihas. The jury, which began deliberating Friday afternoon, told U.S. District Judge Linda H. McLaughlin on Monday afternoon that they were deadlocked on the other nine charges against the 62-year-old defendant. But after conferring with attorneys, McLaughlin ordered the panel back into deliberations.

Jurors deliberated for five hours before agreeing that the 63-year-old doctor duped nine patients into believing that they had deadly diseases such as cancer and AIDS, and then used the mail to bill them and their insurance companies for unnecessary laser surgery.

Namihas, accused of sexually molesting or improperly treating 160 of his patients, failed to honor a summons to appear in court Wednesday because he is helping to build houses for the poor in the Dominican Republic, his lawyer said. Superior Court Judge Francisco F. Firmat had said Tuesday that if Namihas, a Tustin gynecologist, did not appear Wednesday morning to testify in a malpractice case, he would issue a warrant for his arrest.

The county district attorney's office Wednesday announced as expected that it will not bring criminal sexual abuse charges against Tustin gynecologist Ivan C. Namihas, principally because of statute-of-limitations problems. Namihas, 59, had been accused by the California Medical Board of sexually abusing about 50 of his patients, starting as far back as 1982.

A Tustin gynecologist accused of sexually molesting or improperly treating at least 140 patients over a 30-year period was ordered to stop practicing medicine Friday by a commissioner who concluded that he is a danger to the public. Orange County Superior Court Commissioner Eleanor M. Palk granted a temporary restraining order that shuts down Dr. Ivan C. Namihas' practice pending another hearing April 22.
