Convicted embezzler James T. (Tom) Ely, suffering from cancer, was granted another delay in serving his one-year jail sentence Friday so attorneys can review his medical records. Prosecutor Carol Nelson told Ventura County Superior Court Judge Lawrence Storch that she needed several weeks to subpoena and review the files from Ely's doctors at UCLA, where he is undergoing cancer treatment. Storch ordered Ely and his wife, Ingrid, to appear in court on April 3.

Ventura Community College District Trustee James (Tom) Ely and his wife, Ingrid, were arrested here Tuesday on charges that they bilked the district of thousands of dollars in improper trip expenses, authorities said. The Elys were taken into custody by district attorney's investigators about 7:15 p.m., just after they pulled into the driveway of their two-story home in their 1989 Cadillac.

(Tom) Ely, a former trustee with the Ventura County Community College District, was sentenced Tuesday to one year in jail and placed on six years' probation for embezzling at least $15,000 from the college district. Superior Court Judge Lawrence Storch also ordered Ely to pay $14,400 in restitution and ordered Ely's wife, Ingrid, to perform nearly 500 hours of community service for her role in the case.

A teachers union and a Simi Valley citizens group renewed their demand Wednesday that Ventura County Community College District Trustee James (Tom) Ely give up his post, citing criminal charges filed Tuesday against him and his wife, Ingrid. "We would like him to resign," said Larry Miller, chief negotiator for the Ventura County Federation of Teachers, which represents 1,000 faculty members at Moorpark, Ventura and Oxnard colleges.

The filing of charges Tuesday against James (Tom) Ely and his wife, Ingrid, culminate five months of controversy surrounding the 54-year-old trustee of the Ventura County Community College District. Ely, an elected trustee since 1979, was charged with eight counts of embezzlement, 19 counts of making a false or fraudulent claim and two counts of conspiracy to commit grand theft. Ingrid Ely was charged with two counts of conspiracy to commit grand theft.

A Ventura County Community College District official who oversees expense accounts testified Monday that Trustee James (Tom) Ely never wrote a check to reimburse the district for travel expenses of his wife, Ingrid, that he charged on a district credit card. "As soon as they returned from the trips, they were supposed to reimburse the district immediately," said Barbara Buttner, executive assistant to the chancellor of the district.

Prospective jurors were questioned on topics ranging from their use of expense accounts to how often they read the newspaper. Some said they had never heard of Tom Ely. The Elys are accused of conspiring to steal more than $15,000 in Ventura County Community College District funds by padding expense accounts between July, 1988, and January, 1990.

(Tom) Ely, who is suffering from a cancerous tumor on his face, is trying to stop a county prosecutor from reviewing his medical records to determine when he can begin his jail sentence. In a motion Ely filed in Ventura Superior Court, the former college district trustee claims that releasing the information to prosecutor Carol J. Nelson would violate his constitutional rights.
