After years of turmoil, construction on Orange County's most controversial highway--the San Joaquin Hills Transportation Corridor--is likely to begin this Saturday, officials said. The announcement by tollway officials drew an immediate protest from Joel Reynolds, attorney for the Natural Resources Defense Council, a national environmental group that has sued to block construction of the 17.5-mile toll road between Newport Beach and San Juan Capistrano, parallel to Interstate 5.

A coalition of environmental and community groups has appealed approval of a $40-million plan to turn an abandoned railroad yard near Chinatown into an industrial park. Mr. Hewitt is inconsistent in his argument that listing of a species stops development or steals land "through regulatory terrorism." Let's take the example of the desert tortoise. The state of California is presently considering building a radioactive waste dump just west of Needles in tortoise habitat. Yes, the turtle is there. No, the turtle is not stopping the proposal (though it probably should be stopped for other reasons). Hugh Hewitt is patently wrong in asserting that listing of a species prevents development of some kind in that area.

Negotiations to end the bitter legal battle that environmentalists are waging against the San Joaquin Hills tollway are underway, officials said, but how promising the talks are remained a mystery. Questioned about talks aimed at resolving the court dispute, tollway spokesman Mike Stockstill acknowledged that negotiations have taken place but said: "I can't talk about them any further."

County tollway officials asked a federal judge Wednesday to lift a ban on construction of the San Joaquin Hills toll road near Laguna Beach, arguing that there's no longer any need to protect the natural habitat there because it was burned in the recent fire. Tollway officials also argued that the lifting or modification of the court injunction issued by U.S. District Judge Linda A. McLaughlin in September would help protect Laguna Beach-area residents from flooding.

Re "O.C.'s road test," Opinion, March 10 Bobby Shriver's and Joel Reynolds' article regurgitates deceits from an anti-road, pro-gridlock campaign. But it had one thing right: Orange County's traffic needs fixing. The Transportation Corridor Agencies and planning and transportation agencies work together to keep people in motion using all modes of transportation. The 241 toll road wasn't just dreamed up. It was placed on the county's master plan in 1981 -- before the TCA existed.

A federal judge has declined to speed up construction of the San Joaquin Hills toll road. U.S. District Judge Linda McLaughlin canceled a hearing scheduled for Monday that was sought by the San Joaquin Hills Transportation Corridor Agency. In recent weeks, corridor officials had filed briefs asking that construction crews be allowed immediate access to the Laguna Greenbelt area burned in the recent fire.

When Hugh Hewitt wrote his piece on the gnatcatcher controversy, he must not have realized how absurd his rhetoric would seem placed next to fellow attorney Joel Reynolds' carefully wrought position (Commentaries, "Gnatcatcher: Imperiled Species or Specious No-Growth Ploy?" July 28). Reynolds' arguments rely heavily on prevailing opinion in the legitimate scientific community. By contrast, Hewitt relies instead on the incredible claim that the whole scientific community arrayed against him is engaged in a diabolic cabal.
