A Los Angeles Superior Court commissioner Monday dismissed a murder charge in a case tainted by allegations of misconduct by officers in the LAPD's scandal-plagued Rampart Division. Commissioner Michael G. Price threw out the murder charge against Jose Luis Oliverria after determining that the man's constitutional rights were violated at his preliminary hearing.

An 18-year-old woman suspected of belonging to a gang was fatally shot as she used a public telephone in the Westlake district, Los Angeles police said. Moglis Cabrera was in the 2000 block of Westlake Avenue about 7 p.m. Sunday when a man asked for her gang affiliation, said Detective John Curiel of the Rampart Division. When she gave the name of a local gang, the gunman shot her twice in the chest and once in the wrist, Curiel said.

When Larry Bennett, a veteran LAPD detective, arrived at the scene of a brutal rape late last year, the images were enough to sicken even a hardened cop. Two Los Angeles police officers sought to cover up their contact with a 16-year-old gang member who was shot to death on the border of a rival gang's territory just minutes after the officers released him from their patrol car, according to a district attorney's review of the case. Evelio "Rudy" Carrillo said in an interview that he told both the officer and the detective that he knew nothing of the Dec. 4, 1998, drive-by shooting they were investigating.
