After more than two years of efforts, Malibu residents who want their coastal community to become a city got their wish Thursday to put the matter before voters, but it came with a heavy string attached. Complying with a judge's order, Los Angeles County supervisors set a June 5 election date but voted to delay the actual incorporation until March 28, 1991, if residents vote in favor of cityhood. Lawyers for cityhood backers vowed to fight the condition put on their election.

Los Angeles County officials, forced by a judge's order to allow a Malibu cityhood election to proceed in June, may try to delay the actual incorporation for up to a year if residents of the seaside community vote to form a city. A resolution prepared for supervisors to vote on today contains a condition that would allow county officials to impose the delay. Ordinarily, once voters approve, incorporation occurs on the date results are certified, usually four to six weeks after an election.

My first drive to Malibu took place almost 20 years ago. I remember because I was brand new to Los Angeles, so new that the moving boxes stood piled in my apartment. But I wanted to see Malibu, and see it quickly, for reasons I believed to be important at the time. A decade before, back in Tennessee, my father had bought a particular model of Chevrolet named Malibu. And I had grown up dreaming about that stretch of beach, trying to imagine the way it looked.

Two Malibu landmarks, faced with a more than 400% rent increase from a new concession manager, will soon depart from the Malibu Pier. Malibu Sport Fishing and Alice's Restaurant will be replaced by several smaller stores under a new state plan to bring more "family oriented" activities to the pier. Owners of the two popular Malibu businesses have refused to pay the rent increases requested by the new concession manager, Century City attorney Joel Ladin, who says they are the fair market value.

The committee studying alternative sewer plans for Malibu has recommended a $34-million disposal system that would allow a majority of residents to continue using septic tanks.

The Malibu Township Council sued Los Angeles County on Friday seeking to block construction of a $43-million sewer system, alleging fraud, unfair tax assessments and violation of environmental laws. John Murdock, the attorney who brought the Los Angeles Superior Court suit for the community group, also sought a temporary restraining order to halt recording and levying of tax assessments for the controversial sewer system.

In a setback for county officials, the California Coastal Commission on Tuesday approved a regional sewer plan for Malibu substantially smaller than what the county says is necessary for the seaside community. By a 9-1 vote, the commission reduced by half the system's capacity to service commercial users. Opponents of the county's plans said the plan approved Tuesday represents a 25% to 40% reduction in the overall size of the system promoted by the county.

Los Angeles County is considering lending its name to an effort through the courts to strip away about one-third of the five-mile-wide protected Malibu coastal zone created by the Legislature. Led by Supervisor Michael D. Antonovich, who represents San Fernando Valley communities within the coastal zone, the county Board of Supervisors on Tuesday voted 3 to 0 to consider joining a lawsuit to remove about 6,000 parcels from the protected area.

Argues in Malibu Cityhood Case: The Adamson Cos. in Malibu on Wednesday was made a formal party to a Los Angeles Superior Court suit that seeks to force the county Board of Supervisors to schedule a Malibu cityhood election. Judge Dzintra Janavs declined to order the county to immediately schedule an election and took the matter under submission. The supervisors want a sewer system that many Malibu residents believe would encourage unwanted development. The Adamson Cos.
