The state Supreme Court on Thursday let stand a lower court ruling that will require a judge hearing the McMartin Pre-School case to determine whether five child witnesses can testify over closed-circuit television. The court refused to hear a challenge to a recently enacted law that allows children to testify during preliminary hearings via television in cases where they would face extreme trauma by testifying in front of defendants.

The lawyer for accused child molester Ray Buckey, reversing his earlier public denials, has confirmed that prosecutors offered a plea bargain and that he has a tape of the discussions, it was reported today. Defense attorney Daniel Davis, contradicting his own and prosecution denials that the offer was ever made--denials that went as high as Dist. Atty.

Raymond Buckey arrested after a mother said her 2-year-old child had been molested. Buckey is later freed. March, 1984: Four McMartin family members and three other former teachers are indicted. Raymond Buckey is arrested a second time. August: A preliminary hearing for all seven defendants begins.

A federal appeals court Wednesday ruled that Peggy McMartin Buckey should be allowed to amend her pleadings in a multimillion-dollar lawsuit filed against Los Angeles County, the city of Manhattan Beach and others after her acquittal in 1990 on molestation charges in the McMartin Pre-School case. U. S. District Judge Richard A. Gadbois Jr. dismissed Buckey's lawsuit in August, 1990, and denied her the right to amend her pleadings.

Ray Buckey, the sole defendant remaining in the McMartin Pre-School molestation case, took the stand today and denied he ever sexually abused any children. "Were you ever involved in any oral copulation with any children at the preschool?" defense attorney Danny Davis asked Buckey, 32. "Never," Buckey said, duplicating the testimony of his first trial. Did Buckey ever fondle the genitals or chests of any children? Davis asked. "No child, ever," Buckey replied.

Eight more charges were dismissed Monday in the trial of two teachers charged in the McMartin Pre-School molestation case. Los Angeles Superior Court Judge William Pounders dismissed the molestation counts at the request of prosecutors, who said there was insufficient evidence to support the charges. Last week, Pounders dismissed 27 of 99 molestation charges filed against former McMartin preschool teachers Raymond Buckey, 30, and his mother, Peggy McMartin Buckey, 61.
