Garner has been plotting his counterattack against federal regulators who seized his American Commerce National Bank and has been trying to rally both shareholders and depositors to join him in suing the government. His lawyer, Frank P. Barbaro of Santa Ana, said that the bank was in good financial shape and that no one knew anything different.

Old Republic Title Co., one of the largest title insurance companies in Los Angeles, signed a 10-year, $12-million lease to occupy the top two floors of a new nine-story, 200,000-square-foot office building at 450 N. Brand Blvd. in Glendale. Old Republic is slated to move into the building after its scheduled completion date in February, according to Pat Crouch, director of sales for the title company, which has leased 25,000 square feet of office space at 101 E. Glenoaks Blvd.

State Insurance Commissioner Chuck Quackenbush on Monday ordered Old Republic Title Co. to appear at a hearing next month to respond to charges that it used customer escrow deposits to reap more than $30 million for itself over the last decade.

State Controller Kathleen Connell said Wednesday that ongoing audits into escrow companies operating in the state have determined the industry has withheld as much as $500 million from California home buyers during three decades. "We have found . . . an industry-wide practice of pocketing hundreds of millions of dollars from unsuspecting home buyers," Connell told members of the National Women's Political Caucus of Ventura County.

Equating escrow companies' business practices with "petty crime," Controller Kathleen Connell on Monday accused the industry of withholding as much as $500 million from California home buyers in recent decades. Connell made the charge as she announced that she had filed a class-action lawsuit last week against major escrow and title insurance companies seeking to recoup the money on behalf of the state and consumers.
