A man who argued that a 13-year-old girl had consented to have sex with him lost his bid Friday to have his statutory rape conviction overturned. He and the girl are now married and have a child. The Kentucky Court of Appeals rejected Jason Lee Griffith's claim that the state's rape law is unconstitutional because it assumes those under age 16 and unmarried cannot consent to sex. It is legal to have sex with somebody that young if those involved are married.
