Dozens of apartment dwellers in Beverly Hills are enraged over a new rental agreement sent to them recently by the city's biggest landlord, Los Angeles Clippers owner Donald T. Sterling. The leases, scheduled to become effective Oct. 1, would change the tenants' last month's rent to a security deposit and would allow Sterling to deduct 6% of their monthly rent from the security deposit if the tenants don't pay their rent on time.

Question: When I moved my family into our apartment five years ago, the carpets were in very poor shape. They had obviously been installed there several years earlier. During the time we have lived there, the carpets have begun to show signs of wear in every room. In some spots, there is almost no carpet left. I have written to my property manager several times to ask that the carpets be repaired or replaced, but all I get in response are vague promises to "get to it" at some time in the future.

QUESTION: I lived in an apartment in Los Angeles during 1995. I lost the rental agreement when I moved out. Then, the IRS audited me and I could not prove that my two kids lived with me in the same apartment at that time. I called the leasing agent and he told me that they destroy all rental agreements after two years. Can I get a copy of the rental agreement at a public records place, as you can get marriage licenses or birth certificates?

Question: I own a rental home that has been occupied by a very nice tenant for more than 10 years. About two years ago, her adult son moved into the house. When I realized he was living there, I reminded my tenant that her rental agreement required every adult living in the property to be a party to my rental agreement. The son complied, which means both mother and son are now on the month-to-month agreement. But over the last several months, neighbors have told me that the son is growing marijuana in the backyard and selling it to his friends.

Question: In these tough financial times I think a lot of people (myself included) are considering renting out part of their home, if not already doing so. I haven't been successful in trying to look up what the law says about renting a room or part of your house. I read this is different from renting a duplex or regular rental property. Can you provide any guidance? Answer: Your question is timely because many homeowners facing mortgage or other economic stresses are looking at room rentals as an option to increase their income.

Question: I bought a rental property with 10 units about two years ago. There is a nice lawn and sidewalk area in front, and a pool with picnic tables in rear. There is also a parking lot. When I took over the property, the prior owner had already inserted a clause in the rental agreements prohibiting smoking in the units. But tenants and their guests had been allowed to smoke in the common areas, including the front lawn, pool area and parking lot. I am tired of cleaning up after the smokers and tired of listening to complaints from the nonsmoking tenants.

Question: Is it true that landlords must provide tenants with blinds or curtains for their windows? I live in Mar Vista and my landlord says no but many of my friends are telling me yes. Who's right? Answer: Landlords generally provide window coverings in the form of blinds or drapes for windows in rentals. However, while it is true that landlords must provide tenants with unbroken window panes and intact window screens for their windows, the law does not cover blinds or curtains.

Question: When I recently signed a lease for an apartment, the community manager told me the owners wanted all rent payments to be made by automatic deposit in the community's bank account. I told her I wasn't comfortable with automatic transfers because I was the victim of an identity theft a couple of years ago. I signed the lease anyway, although it specified that rent must be paid by automatic transfer and deposit. Since I moved in, I find myself still feeling uneasy about paying my rent this way. Is there anything I can do about it?

During these recent summer months, I noticed that in addition to the tenant on my lease, there is another fellow sleeping on a lounge chair in the backyard. My tenant says this guy is his guest, and that he will be staying there the entire summer. I am not happy with this arrangement. Is there is any action I can take to remove "Mr. Outdoors"? Answer: First, check your rental agreement.

Question: I own a second home that I rent to a couple. They have lived there for eight months. Recently, the wife told me they would like to install a 220-volt electrical outlet in the garage so that they can use a heavy-duty washer/dryer combo. I trust them, but I still want to check whether I am required to allow them to make this alteration and, if so, what my rights are if something goes wrong. Answer: Hopefully, you have a carefully drafted rental agreement that precludes any physical alterations to the rental unit without your permission.

Tenants kept control of the office rental market in the second quarter as Southern California landlords confronted acres of empty space and felt pressure to reduce rents. The number of signed leases continued to grow as business owners took advantage of the situation, brokers said, but most tenants who renewed their rental agreements decreased the amount of space they occupied. The average reduction was 15%. "Rents are still weak," spurring tenants to lock in deals, said Joe Vargas, an executive vice president at brokerage Cushman & Wakefield.

Question: I have just bought an apartment building with four units and am a first-time landlord. The previous owner gave me a set of keys for the units. When I tried to enter one of the units recently when the tenant wasn't home, the key did not work. I suspect the tenant changed the lock without telling me or the prior owner. I was thinking about just having a locksmith come to the property and change the lock. Would I be within my rights? Answer: A landlord has a right to access a rental unit and a right to a key to the unit to gain access.

QUESTION: About eight months ago, we assumed tenancy of a house. This summer our landlord instructed us not to pick the fruit, that it belongs to his family and that they would be over to harvest it when it was ripe. We are responsible for maintaining and watering the yard, are we not entitled to the fruit on the trees? ANSWER: Residential rentals usually provide for exclusive use of the property by the tenants.

Question: I just rented a cottage on a lot that includes fruit trees in the backyard. I was looking forward to living here but the woman who owns the cottage is ruining my peace and quiet. She lives nearby and everyday, without any warning, goes into the yard to tend to the fruit trees. I feel that I cannot go out into the yard because she is hanging around so often, which means I have lost the use of the backyard for which I am paying. When I complained to her, she pointed out that my rental agreement allows her to enter the yard any time she feels it is necessary.

Question: A tenant who just moved into our apartment community has asked if he can repaint his apartment in a different color. He says he is willing to bear the cost. However, as the property supervisor, I am worried about what color the tenant will pick. Do I have to allow it, and if I allow it, who pays to remove the paint when this tenant vacates, if the color is ugly? Answer: A tenant has a duty to leave a rental unit in the same condition that existed at the time of move-in, minus normal wear and tear.
