A convicted rapist was charged Monday with two counts of murder for the 1993 slayings of two San Diego boys who disappeared during an afternoon bicycle ride. Scott Erskine, serving a 70-year term in the state prison in Lancaster, also was charged with three counts of special circumstances: torture, sexual assault and multiple murders.

Dist. Atty. Bonnie Dumanis announced Wednesday that her office would retry the penalty phase of the trial of Scott Thomas Erskine, 40, for the rape, torture and murder of two San Diego boys in 1993. Erskine, serving a 70-year sentence for raping a woman in 1993, was convicted in October of the murders of Charlie Keever, 9, and Jonathan Sellers, 13. A jury this week deadlocked 11 to 1 in favor of death.

A mistrial was declared Monday after a jury deadlocked 11 to 1 in favor of death for a 40-year-old sex offender convicted of the 1993 torture and murder of two boys in the Palm City neighborhood of San Diego. Scott Thomas Erskine, 40, had been convicted in the deaths of Charlie Keever, 9, and Jonathan Sellers, 13. Erskine is serving a 70-year sentence for raping a woman six months after the slayings.

New developments in DNA analysis linked Scott Erskine, who is serving a 70-year term in Wasco State Prison, to the slayings of Charles Keever, 13, and Jonathan Sellers, 9. One boy was sexually assaulted.
