A city zoning official has denied the Studio City Golf Course a conditional use permit, noting that while he feels the operation is a welcome swath of green in the otherwise urban area, he has no choice but to deny the request until legal questions surrounding the course's lease agreement are resolved. "I would have liked to approve the permit," said Assistant Los Angeles Zoning Administrator Horace Tramel. "Partially on the advice of the city attorney, I denied the request."

It all started with Great Uncle Fred. Half a century ago, the stubborn old banker had a mind to rent out the family farm. A rather bad deal in retrospect: $1,000 a month, regardless of inflation, for 50 years. That choice chunk of San Fernando Valley real estate is now the Studio City Golf and Tennis Club, a 17-acre spread still owned by Fred Weddington's great-nephew and other relatives.

Greening the urban gray for nearly four decades, the land occupied by the popular Studio City Golf Course is up for sale. People who know area real estate say the $10-million asking price is a bargain and, should it sell, the property could be open to development. The 17.2 acres in the heart of Studio City--sporting a nine-hole golf course, driving range and tennis courts--are being offered for sale by the Weddington Investment Partnership.

The Los Angeles Board of Zoning Appeals has granted the Studio City Golf Course a new permit to operate a course in an agricultural zone, a defeat for the owners of the land. Weddington Investment Partnership had been trying to renegotiate the lease or evict the golf course operators. "We were very pleased by the enthusiastic and positive response from the Board of Zoning Appeals," said George McCallister, golf course manager.

Prospective buyers are buzzing around a parcel of land currently occupied by the Studio City Golf Course, according to the realtor representing the property owner. Studio City realtor Mort Allen said that since a June 26 newspaper report appeared about potential development of the site, 18 interested parties have contacted him about the property. Of the 18, Allen said, the property owner--Weddington Investment Partnership--is focusing on four.

A Los Angeles Superior Court judge dismissed a lawsuit Thursday against the operators of a Studio City golf course, delivering a blow to owners of the land who wanted to renegotiate the lease or evict the operators. "I'm elated," said George McCallister, golf course manager. "I'm sure that the rest of the neighborhood is happy they aren't going to lose their golf course," he said.

Operators of the Studio City Golf Course have been served an eviction notice by the property's owners, initiating what both sides agree will probably become a lengthy legal wrangle over the property. The Weddington Investment Partnership served the golf course--a 17.2-acre swath of green near the intersection of Whitsett Avenue and Ventura Boulevard--a 30-day termination of tenancy notice July 15, said Los Angeles attorney Jerald Gale, who is representing the partnership.

Operators of the Studio City Golf Course will go before a zoning administrator Aug. 22 to ask for a conditional-use permit to keep the course open. The course has been served an eviction notice by the property owners, based on the fact that its conditional-use permit expired nearly a decade ago. The Weddington Investment Partnership, which owns the land, discovered this spring that the course's conditional-use permit expired in May, 1985.
