In a decision involving a Ventura Harbor marina development bankruptcy, the state Supreme Court said Thursday that local governments cannot be forced to pay for lawsuit settlements by raising property taxes. Taxpayer advocates praised the decision, saying that a ruling favorable to the Ventura Port District's creditors would have paved the way for tax increases statewide and virtually overturned portions of Proposition 13, which limits property tax increases.

The state Court of Appeal has upheld a multimillion-dollar judgment against the Ventura Port District in favor of a former development firm that went bankrupt after lengthy delays in its attempts to build the Ventura Harbor Village. Although it reduced the monetary award slightly--to $15.6 million--the appellate panel in Ventura ruled unanimously that the port district, which runs the Ventura Harbor, did not act in good faith in its dealings with Ocean Services Corp.

The sun is shining, frosting the surface of the calm, blue water at Ventura Harbor with glints of bright light. In the narrow channel, a dozen people paddle rented purple, red and yellow kayaks around yachts and sailboats resting in their slips. Along the shoreline, above the docks, countless people mill about, casually perusing merchant wares and listening to the beat of a Calypso band.
